When Does The New Association Health Plan Regulation Become Effective?

An interesting aspect of the new regulation on association health insurance plans is that the effective date for the regulation is staggered. In other words, the regulation has multiple implementation dates. The new rules become effective in the marketplace at different times depending on:
- The history of the association (i.e. brand new associations versus associations that had existed by August 20, 2018)
- Whether the association health plan is self-insured or insured through a third-party insurance company
In this later item, association health plans that are insured through a third-party insurance company are known as “fully-insured.”
Below are the implementation dates for the regulation based on association history and insurance type:
- September 1, 2018: New fully-insured association health plans
- January 1, 2019: Existing self-insured association health plans
- April 1, 2019: New self-insured association health plans
